Terms of Service

1. Acceptance of these terms

These Terms of Service govern your use of futurisxgroup.com (the "Site"), operated by FuturisX Group Pvt. Ltd., a company registered in Nepal with its office in Kathmandu ("FuturisX", "we", "us").

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. The Site is informational

The Site describes who we are and what we do. It is marketing and informational material only.

Nothing on the Site is an offer capable of acceptance, a quotation, a commitment to provide services, or professional advice on which you should act without further consultation. Descriptions of our software engineering, artificial intelligence and automation, cybersecurity, and IT consulting work are general summaries, not specifications of what any particular engagement will include.

Using the Site does not create a client relationship with FuturisX. We take on work only under a separate written agreement signed by both parties, which sets out the scope, deliverables, timelines, fees, confidentiality, warranties, and liability terms for that engagement. Where those terms differ from these Terms, the signed agreement governs the engagement.

3. Contacting us through the Site

The Site has no server-side processing. The contact form does not submit anything to us; it opens a pre-addressed message in your own email application, and nothing reaches us unless you choose to send it yourself. Once sent, your message travels through your own email provider and ours.

Sending us a message does not oblige us to reply, to accept an engagement, or to keep the message confidential unless we have separately agreed to do so. Please do not send confidential, sensitive, or security-critical information — credentials, personal data belonging to third parties, or details of live vulnerabilities — by unsolicited email. If you need to share something sensitive, contact us first and we will arrange an appropriate channel.

4. Permitted use

You may view, browse, and print pages of the Site for your own personal or internal business purposes, and you may link to it fairly and without implying an endorsement or association that does not exist.

Prohibited conduct

You must not:

  • Use the Site for any unlawful purpose, or in a way that breaches the Electronic Transactions Act 2063 (2008) or any other applicable Nepali law.
  • Attempt to gain unauthorised access to the Site, its hosting infrastructure, or any connected system or account.
  • Probe, scan, or test the security of the Site or its infrastructure, or interfere with its normal operation, without our prior written permission.
  • Introduce malware, or use the Site to distribute malicious code.
  • Scrape, harvest, or systematically extract content from the Site for republication, for building a competing offering, or for training machine-learning models, without our prior written permission.
  • Place an unreasonable load on the Site through automated requests.
  • Copy, reproduce, adapt, or republish the Site's content, code, or design beyond what these Terms or applicable law permit.
  • Remove, obscure, or alter any copyright, trade mark, or other proprietary notice.
  • Misrepresent your identity or your affiliation with FuturisX, or use our name or branding in a way that suggests a partnership, endorsement, or client relationship that does not exist.

5. Intellectual property

The Site and its contents — including the text, layout, design, generated graphics and animations, source code, and the FuturisX name, logo, and other branding — are owned by FuturisX Group Pvt. Ltd. or used under licence, and are protected by Nepali copyright law and by international treaties Nepal is party to.

These Terms grant you no licence to our intellectual property beyond the limited permitted use described above. All rights not expressly granted are reserved.

6. Client names and third-party marks

Client names, logos, and trade marks shown on the Site remain the property of their respective owners and are displayed with those owners' permission, solely to identify work we have carried out. Their appearance does not transfer any rights to you, and nothing on the Site grants you permission to use them.

If you own a mark shown on the Site and want its use reviewed or removed, contact us at company@futurisxgroup.com and we will respond promptly.

7. Third-party links and embedded content

The Site links out to client websites and to our profiles on Instagram, Facebook, and LinkedIn. It also embeds a Google Maps frame and loads fonts served by Google.

We do not control these third parties, their content, or their practices. Loading an embedded map or font, or following an outbound link, connects you to that provider's servers, which will receive your IP address and may set cookies under their own terms. Their terms and privacy policies apply to that interaction, not ours. We include these links and embeds for convenience and are not responsible for third-party content, availability, or conduct. Our Privacy Policy explains what this means for your data.

8. Availability and changes to the Site

We aim to keep the Site available and current, but we do not guarantee uninterrupted access. We may change, suspend, or withdraw any part of the Site, or take it down entirely, at any time and without notice. Content may become out of date, and we are under no obligation to update it.

9. No warranty

The Site and everything on it are provided "as is" and "as available", without warranty of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, non-infringement, accuracy, and freedom from error or interruption. We do not warrant that the Site will be free of defects or malicious code, or that any information on it is complete, accurate, or applicable to your situation.

Nothing in this section limits any warranty we give in a signed engagement agreement, which stands on its own terms.

10. Limitation of liability

To the fullest extent permitted by Nepali law, FuturisX Group Pvt. Ltd. and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profit, revenue, business, data, or goodwill, arising out of or connected with your use of, or inability to use, the Site — whether the claim is framed in contract, tort, negligence, or otherwise, and whether or not we were advised such loss was possible.

This includes loss arising from reliance on information published on the Site, from third-party content or links, and from any interruption or unavailability of the Site.

Nothing here excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.

Liability arising from services we actually perform is governed by the signed agreement for that engagement, not by this section.

11. Indemnity

You agree to indemnify FuturisX against any claim, loss, or reasonable cost arising from your misuse of the Site or your breach of these Terms.

12. Governing law and venue

These Terms and any dispute or claim arising out of them or out of your use of the Site — including non-contractual disputes — are governed by the laws of Nepal.

The courts of Kathmandu, Nepal have exclusive jurisdiction to settle any such dispute. Where a consumer protection law in your country of residence gives you a mandatory right to bring proceedings elsewhere, that right is unaffected.

Use of the Site is subject to Nepali law regardless of where you access it from, and you are responsible for complying with the laws of your own jurisdiction. Data protection matters are handled under the Individual Privacy Act 2075 (2018) and, where the General Data Protection Regulation applies to visitors in the European Economic Area, under that Regulation — see our Privacy Policy.

13. General

  • If any provision of these Terms is found unenforceable, the rest remain in force and the provision is applied to the greatest extent the law allows.
  • If we do not enforce a right under these Terms straight away, we do not waive it.
  • These Terms are between you and FuturisX and create no rights for anyone else.
  • Together with our Privacy Policy, these Terms are the whole agreement between us regarding the Site.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes in how the Site works or in the law. The version published here is always the current one, and the effective date at the top shows when it last changed. Continuing to use the Site after a change means you accept the updated Terms. Changes are not retroactive and do not alter the terms of a signed engagement agreement.
